The terms that govern your use of the HASHTAG YOUR STORY website and your engagement with our services.
By engaging our services or using www.hashtagyourstory.com (the "Website"), you agree to these Terms & Conditions (the "Terms").
Our Services
HASHTAG YOUR STORY provides marketing, branding, growth, creative, social media, performance marketing, search and growth, analytics, and AI solutions as agreed in the applicable package, proposal, or custom scope of work.
The exact services, deliverables, timelines, platforms, reporting cadence, and responsibilities for an engagement are determined by the applicable onboarding agreement, statement of work, proposal, or package selection.
Packages, Fees & Payment
We offer standard partnership tiers, including Starter, Growth, and Business, together with custom engagements. Monthly rates are the rates displayed or quoted at the time of signup unless otherwise agreed in writing.
Fees are payable in advance on the agreed billing date using the payment method specified by us. Late or failed payments may result in work being paused until outstanding amounts are settled.
Prices may change for future billing cycles with reasonable prior notice. A committed term or agreed project fee will not be changed retroactively unless both parties agree otherwise in writing.
Term, Renewal & Cancellation
Standard partnerships may be offered on 3, 6, or 12-month commitments, depending on the selected plan or written agreement.
Where a discounted rate is tied to a committed term, the discount is conditional on the Client completing that committed term. Any adjustment or early-exit charge will be governed by the applicable agreement.
After the minimum committed term, an engagement may continue on a month-to-month basis unless otherwise stated in writing. Cancellation requests should be made in writing.
Advertising & Third-Party Spend
Paid media, advertising spend, influencer fees, production expenses, platform fees, software subscriptions, and other approved third-party costs are separate from our service fees unless expressly included in writing.
Advertising budgets are set and approved by the Client in advance. Amounts paid to advertising platforms are subject to those platforms' own policies and refund rules and are not refundable by HASHTAG YOUR STORY once spent.
AI Solutions & Custom Technology
Custom AI implementations, including chatbots, workflow automation, lead qualification systems, business intelligence systems, integrations, and other technology projects are scoped and quoted separately unless expressly included in a written package.
Custom technology work may be governed by a separate statement of work covering scope, deliverables, dependencies, hosting, third-party services, licensing, acceptance criteria, and support.
Client Responsibilities
The Client agrees to provide timely feedback, approvals, brand assets, content inputs, factual information, credentials, and other access reasonably required to deliver the agreed work.
The Client remains responsible for the accuracy, legality, ownership, and authorization of materials and information supplied to us. Delays in approvals, access, or required inputs may affect delivery timelines.
Intellectual Property
Subject to full payment of all amounts due, final paid-for deliverables specifically created for the Client under the engagement are transferred to the Client to the extent described in the applicable agreement.
HASHTAG YOUR STORY retains ownership of its pre-existing materials, internal processes, templates, know-how, methodologies, tools, software, reusable components, and third-party materials unless otherwise agreed in writing.
Unless confidentiality has been agreed in writing, we may display completed work created for the Client in our portfolio, website, presentations, and other marketing materials.
Confidentiality
Each party agrees to keep confidential non-public business, commercial, technical, financial, customer, strategic, and operational information received from the other party in connection with the engagement.
Confidentiality obligations do not apply to information that is publicly available without breach, was already lawfully known, is independently developed, or must be disclosed by law or lawful authority.
Performance & Results
We work toward agreed business and marketing objectives, which may include reach, engagement, leads, conversions, traffic, growth, or efficiency.
We do not guarantee a particular level of revenue, reach, engagement, follower growth, lead volume, conversion rate, return on advertising spend, or other outcome unless a written agreement expressly states otherwise.
Results can be affected by factors outside our reasonable control, including platform algorithms, market conditions, media costs, competition, third-party outages, audience behavior, Client approvals, budgets, and changes to platform policies.
Content, Approvals & Compliance
The Client is responsible for reviewing and approving final content, claims, offers, pricing, promotions, product information, and other business statements before publication where approval is required.
The Client is responsible for ensuring that it has the rights, permissions, licences, releases, and consents necessary for materials, brands, music, images, testimonials, customer data, and other content supplied for use in the engagement.
Cancellation, Refunds & Service Pauses
Fees for services already rendered are non-refundable unless otherwise agreed in writing or required by applicable law.
Approved third-party costs, media spend, production costs, or other external charges may be non-refundable once committed or incurred.
We may pause active work where invoices remain unpaid, required approvals or inputs are materially delayed, or the Client is otherwise in material breach of the applicable agreement.
Limitation of Liability
To the maximum extent permitted by applicable law, HASHTAG YOUR STORY's aggregate liability arising from an engagement will be limited to the fees actually paid by the Client to HASHTAG YOUR STORY for the relevant services during the month in which the event giving rise to the claim occurred.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses, including loss of profits, revenue, business opportunity, goodwill, or anticipated savings.
Termination
Either party may terminate an engagement in accordance with the applicable notice and commitment terms.
We may suspend or terminate services where the Client materially breaches these Terms, fails to pay amounts due, misuses our services or systems, or requests work that would reasonably require us to violate applicable law or third-party platform rules.
Governing Law & Jurisdiction
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Subject to any applicable mandatory legal rights, disputes arising from these Terms or the relevant engagement will be subject to the jurisdiction of the courts having lawful jurisdiction over the parties and the matter.
